These Terms and Conditions govern the use of the website https://hojasdeolivo.eu and the purchase of products offered through it.

By placing an order through this website, you confirm that you have read and accepted these Terms and Conditions.

1. Products

Hojas de Olivo by DelPueblo specialises in fresh olive leaves, fresh olive branches and other olive-related botanical products described individually on the website.

Our products are natural and are harvested and prepared for each order whenever possible.

Because they come directly from olive trees, variations in colour, size, shape, density, leaf arrangement, branch thickness and general appearance are normal.

Photographs on the website represent the type and quality of product offered but cannot guarantee that every individual leaf or branch will be identical to those shown.

Natural variations are not considered product defects.

The intended use of each product is specified in its individual product description. Customers are responsible for using the product according to the information provided on the website.

2. Availability and seasonality

Our products depend on natural growing conditions, seasonality, weather and the condition of the olive trees.

For this reason, availability may change throughout the year.

We reserve the right to temporarily suspend a product, change available quantities or cancel an order if we are unable to supply the product in suitable condition.

If an order cannot be fulfilled after payment has been made, the customer will be informed and the corresponding amount will be refunded.

3. Prices

All prices displayed on the website are expressed in euros (€).

Applicable taxes are included in the displayed product prices where required.

Shipping charges are calculated separately during checkout according to the destination, weight and shipping method selected.

The final total payable will always be shown before the customer confirms the order.

We reserve the right to change prices at any time. Any price change will not affect orders that have already been confirmed.

4. Orders

The customer is responsible for ensuring that all information supplied during checkout is complete and accurate.

After placing an order, the customer will receive an electronic confirmation.

Receipt of an automatic order confirmation does not prevent us from cancelling an order in exceptional circumstances such as:

lack of suitable stock, an obvious pricing or technical error, payment failure, an unavailable destination or circumstances that prevent us from preparing or shipping the product correctly.

If we cancel an order that has already been paid, the amount charged will be refunded.

5. Payment

Available payment methods are displayed during checkout.

Payment must be successfully completed before an order is prepared or dispatched unless another arrangement has been expressly agreed.

Payment information may be processed by third-party payment providers. Hojas de Olivo by DelPueblo does not store full bank card details when payments are processed through external payment platforms.

6. Harvesting and preparation

Fresh leaves and branches are harvested and prepared as close as reasonably possible to the shipping date in order to maintain their freshness and quality.

Harvesting may therefore take place shortly before dispatch rather than immediately after the customer places the order.

Orders are packaged according to the characteristics and quantity of the product.

As these are fresh botanical products, some natural moisture loss or change in appearance may occur between harvesting and delivery.

7. Shipping destinations

We currently ship to Spain, Portugal and selected countries within the European Union.

Available destinations may change depending on transport conditions and the services available from our carriers.

Countries or territories requiring special customs procedures may not be available for online ordering.

If no shipping option is displayed for a destination during checkout, this means that online shipping is not currently available for that destination.

8. Shipping methods and delivery times

Available shipping methods and their prices are displayed during checkout.

Depending on the destination, customers may be offered different services, including economy road transport and express air transport.

Estimated delivery times are indicative and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by weekends, public holidays, weather conditions, transport network incidents, remote delivery areas, exceptional demand or other circumstances outside our reasonable control.

A delay caused by the transport provider does not automatically mean that the product is defective or that the order must be refunded.

However, if a serious delay affects the condition of the fresh product, please contact us so that we can review the case.

9. Delivery information

The customer must provide a correct and complete:

name, delivery address, postal code, city, country, email address and telephone number.

The telephone number may be provided to the transport company when necessary to facilitate delivery.

Hojas de Olivo by DelPueblo cannot be held responsible for delivery problems caused by incorrect, incomplete or outdated information supplied by the customer.

If a shipment must be resent because of incorrect customer information or because the recipient failed to receive the package, additional shipping charges may apply.

10. Fresh and natural products

Olive leaves and branches are living or recently harvested botanical materials.

During transport they may experience slight dehydration, bending, movement inside the packaging or minor aesthetic changes.

These normal characteristics of transporting fresh plant material do not necessarily mean that the product is defective.

Customers should open the package promptly after delivery and follow any care or storage recommendations included with the product or published on our website.

11. Damaged, incorrect or defective orders

If an order arrives seriously damaged, incomplete, incorrect or in a condition that is clearly inconsistent with what was purchased, please contact us at:

Please contact us as soon as reasonably possible after delivery.

To help us assess the incident, we may request photographs of:

the product, the outer packaging, the inner packaging and the shipping label.

Please do not discard the product or packaging until the incident has been reviewed whenever reasonably possible.

12. Returns and right of withdrawal

Our olive leaves and branches are fresh botanical products that may deteriorate over time.

Where the legal exception for goods liable to deteriorate or expire rapidly applies, the standard right of withdrawal for distance purchases may not apply.

For this reason, we may not accept returns of fresh products solely because the customer has changed their mind after the product has been harvested, prepared or dispatched.

This does not limit the customer's legal rights when a product is damaged, incorrect, defective or otherwise not in conformity with the order.

13. Refunds and replacements

When we confirm that an order has arrived damaged, incorrect or materially defective, we will determine the most appropriate solution according to the circumstances.

This may include a replacement, partial refund or full refund.

Any refund will normally be made using the same payment method used for the original purchase.

Shipping charges may also be refunded where appropriate according to the circumstances of the incident and applicable consumer legislation.

14. Order cancellations

We will try to cancel it if harvesting, preparation or dispatch has not yet taken place.

Once a fresh product has already been harvested or prepared specifically for the order, cancellation may no longer be possible where permitted by applicable law.

15. Promotions and discount codes

Promotional codes and discounts may be subject to specific conditions, expiration dates, minimum order amounts or product restrictions.

Unless otherwise stated, promotional codes cannot be exchanged for cash or combined with other offers.

We reserve the right to cancel a promotion in the event of fraud, abuse or an obvious technical error.

16. Intellectual property

Unless otherwise stated, all content on hojasdeolivo.eu, including photographs, text, graphics, logos, design elements and branding, belongs to ASOCIACIÓN AGROALIMENTARIA DELPUEBLO or is used with the necessary permission.

Content may not be reproduced, distributed, sold or commercially exploited without prior permission.

Sharing links to publicly available pages of the website is permitted provided that it does not falsely imply any partnership, endorsement or association.

17. Website availability

We aim to keep the website available and information accurate, but we cannot guarantee uninterrupted access.

We may temporarily suspend or modify parts of the website for maintenance, technical reasons, security updates or improvements.

We reserve the right to correct typographical, technical or pricing errors.

18. Limitation of liability

Nothing in these Terms and Conditions limits any consumer rights that cannot legally be excluded.

Within the limits permitted by law, we will not be responsible for delays or failures caused by events outside our reasonable control, including extreme weather, transport disruptions, strikes, natural events, technical failures or force majeure.

We are not responsible for deterioration caused by improper handling or storage after successful delivery.

19. Personal data

Personal data collected during purchases or enquiries is processed in accordance with our Privacy Policy and applicable data protection legislation.

Customer information may be shared with service providers when necessary to process payments, prepare orders, deliver shipments, provide customer service or comply with legal obligations.

20. Applicable law and consumer rights

These Terms and Conditions are governed by Spanish law.

If you are a consumer residing in another European Union country, this does not deprive you of any mandatory consumer protection rights applicable under the laws of your country of residence.

Nothing in these Terms and Conditions is intended to restrict rights granted to consumers under applicable Spanish or European Union legislation.

21. Changes to these Terms and Conditions

We may update these Terms and Conditions when necessary to reflect changes in our products, services, business operations or legal requirements.

The version applicable to an order will be the version published on the website at the time the order is placed.
